  3. 99 hours

A brokerage's stated policy is that its licensees will only act as single agents for 1-to-4 family residential deals, never as dual agents. What follows?

  1. The policy has no legal effect on individual licensee conduct, regardless of what the firm states
  2. Licensees may still act as dual agents whenever convenient, policy notwithstanding, without any written exception
  3. The firm must register the policy with the federal government before it may lawfully operate anywhere in the United States
  4. Licensees at that firm may not function as common law agents for such properties unless that single-agent-only relationship is properly established in writing
Show answer & explanation

Licensees at that firm may not function as common law agents for such properties unless that single-agent-only relationship is properly established in writing — Delaware law requires that a common-law (single) agency relationship for 1-to-4 family residential deals be properly established in writing, consistent with a brokerage policy against dual agency — the policy alone doesn't override the writing requirement.
